By-law 2025-079: A by-law to amend Zoning By-law 2016-040 (rezoning of property at 3 Water Street)
Purpose
This by-law changes the city's zoning map and rules to allow a commercial expansion on the property located at 3 Water Street in the downtown area. The goal is to give you, the property owner, permission to grow your business footprint while keeping the neighbourhood safe and accessible.
What it does
The amendment updates the zoning designation for your specific lot. It aligns the property's permitted uses with the surrounding commercial corridor. The changes also adjust building height and setback requirements so your new expansion fits within the city's downtown design standards. Any construction you start must still follow the Ontario Building Code, 1992 and the city's site plan control rules.
Who it applies to
This by-law applies only to the property at 3 Water Street. It does not change the zoning for neighbouring lots or affect other businesses in the downtown core. You can still apply for your own zoning amendments through the planning process if you own property in a similar zone.
Fines
If you carry out work or change the use of the land without following the updated zoning rules, you may face penalties under the Municipal Act, 2001. The city can issue orders to stop work, require removal of unauthorized structures, or impose fines. Repeated violations will lead to daily penalties until you fix the issue.
When it takes effect
The by-law came into force immediately after council passed it on June 9, 2025. Planning staff began processing related permits the next business day.
What it amends
This by-law amends the Zoning By-law 2016-040. It does not repeal any existing sections. All other zoning rules for the city remain unchanged.
