By-law 2025-048: A by-law to amend Zoning By-law 2016-040 (Heritage Designation - 12 Mercer Street)

By-law 2025-048 designates the property located at 12 Mercer Street as a heritage property and introduces conservation controls through an amendment to the Zoning By-law. The purpose of this by-law is to protect the historical and architectural character of the building for future generations by ensuring that any modifications respect its original design.

This by-law amends Zoning By-law 2016-040 by creating a new heritage overlay district that covers the site. Once designated, the property owner must obtain a heritage alteration permit before making any changes to the exterior walls, rooflines, windows, doors, or surrounding landscape features. The goal is to maintain the streetscape's historical integrity while allowing for sensitive updates that meet modern safety standards.

The controls apply directly to the owner of 12 Mercer Street, as well as any future purchasers, property managers, or contractors who undertake work on the land. If you own the building or plan to renovate it, you must submit your plans to the Heritage Advisory Committee for review before proceeding.

Violations of the heritage conservation controls are enforceable under provincial legislation. Fines for a first offence start at $500.00, and repeated violations can result in higher penalties, including daily fines for ongoing non-compliance.

The by-law took effect on April 28, 2025, the day it was passed by council. It does not repeal any existing zoning or heritage by-laws; it simply adds new protections to the specified property.
