By-law 2024-012: A by-law to amend Zoning By-law 2016-040 (secondary suite allowance on Mercer Street)
About this by-law
This by-law updates the Zoning By-law 2016-040 to allow a secondary suite on a residential property at 42 Mercer Street. A secondary suite is a self-contained living space within a main house or a detached garage that includes its own kitchen, bathroom and sleeping area.
What it does
The amendment makes the secondary suite a permitted use on this specific lot. It sets clear rules for the property, including minimum lot size and parking requirements. You must provide at least one additional parking space for the suite. The suite must meet the Ontario Building Code for safety, including fire separation and egress windows.
Who it applies to
This by-law applies only to the property at 42 Mercer Street. It does not change the rules for other homes on Mercer Street or elsewhere in the city. If you live in a different neighbourhood, check the Zoning By-law 2016-040 to see what is allowed on your property.
Fines and enforcement
Building a secondary suite without the required permits or not following the rules in this by-law can lead to fines under the Municipal Act, 2001. By-law Enforcement Officers can issue tickets for violations. Fines start at $500.00 for a first offence and can go up to $2,500.00 for repeat offences.
When it takes effect
This by-law takes effect on the day it is passed, February 12, 2024. It amends the Zoning By-law 2016-040 to add a new zoning schedule for 42 Mercer Street. No other by-laws are repealed.
