By-law 2024-067: Sidewalk Patio Safety By-law
The Sidewalk Patio Safety By-law 2024-067 helps keep your downtown sidewalks clear and safe for everyone. If you run a café, restaurant, or shop that wants to place tables, chairs, or service areas on the public sidewalk, this by-law sets the rules you need to follow.
Under the by-law, all patios must stay within the downtown boundary, roughly along Mercer Street between Water Street and Market Square. Outdoor furniture cannot block pedestrian pathways, cross over into the street, or hide fire hydrants. Businesses must also keep noise levels down so neighbours and shoppers aren't disturbed. A permit is required, and the City will inspect patios to make sure they meet these standards.
This by-law applies to every business operating a sidewalk patio in the downtown core. If you already have a patio, you will need to adjust your layout to follow the new safety rules. The City provides a simple checklist so you can get your permit quickly.
Fines apply for violations. If your patio blocks a walkway or fails an inspection, you may receive a fine under the Provincial Offences Act. Repeat offences can lead to higher penalties or the removal of your patio permit.
The by-law takes effect on June 1, 2024. It does not repeal any older sidewalk rules but adds clear safety standards for outdoor dining. Council passed this by-law on May 13, 2024, during the regular council meeting. A certified copy is available for review at the Clerk's office, City Hall, or through the by-law search portal.
