By-law 2024-033: A by-law to amend Zoning By-law 2016-040 (rezoning of property at 42 Mercer Street)
Purpose
By-law 2024-033 changes the zoning rules for the property at 42 Mercer Street in the Downtown neighbourhood. Council passed this by-law on March 11, 2024, at the regular Council meeting.
What this by-law does
This by-law updates the Zoning By-law 2016-040 to allow mixed-use development on the site. This means the property can now host both residential units and commercial spaces, such as retail shops or offices, under one roof. The change supports the City's goal of creating vibrant, walkable neighbourhoods where residents can live, work, and shop in the same area.
Who it applies to
The new zoning rules apply only to the specific lot at 42 Mercer Street. Property owners in the surrounding area are not affected by this change. Developers and property owners looking to build or renovate on this lot must follow the new mixed-use zoning standards and obtain the necessary building and development permits from Planning & Development.
Fines and enforcement
While this by-law itself does not set new fines, all development on the property must still follow the rules in Zoning By-law 2016-040. If a property owner builds without a permit or violates the zoning rules, they may face fines or orders to stop work under the Municipal Act, 2001 and the Zoning By-law.
When it takes effect
The by-law took effect on March 11, 2024, the day Council voted to pass it. Any development applications submitted for 42 Mercer Street will be reviewed under these updated rules.
What it amends
This by-law amends Zoning By-law 2016-040, the City's main land-use planning document. It does not repeal any existing by-laws.
