Committee of Adjustment meeting, January 17, 2024
Attendance
The Chair, the Vice-Chair, and three members were present to hear the day's business. Staff included the Secretary-Treasurer, who managed the records, and a Planner, who provided technical advice on zoning rules. You can check the full roster on our committee page.
Delegations
One resident from the Benchlands neighbourhood attended to speak in support of a minor variance request. They noted that the proposed change would not affect traffic or sightlines on the street.
Reports and decisions
The Committee reviewed six applications against the Zoning By-law. Here is what happened:
- A minor variance at 45 Mercer Street was approved to allow a detached garage to sit 0.5 metres closer to the rear property line. The applicant provided a survey showing no impact on neighbours. The vote was 3-2 in favour.
- A consent at 12 Tamsin Street was approved to create a shared access easement for a secondary suite. The Planner confirmed that fire safety and parking requirements were met. The vote was unanimous.
- A minor variance at 88 Mill Street was approved for a front porch that extends 1.2 metres into the required front yard setback. The vote was 4-1 in favour.
- An application to sever a portion of land at 22 Albert Street was denied. The Planner noted that the resulting lot would not meet minimum lot area requirements. The vote was 3-2 against.
- A minor variance at 15 Eastfield Road was approved for a retaining wall that exceeds the standard height limit by 0.3 metres. The vote was 4-1 in favour.
- A consent application at 300 Railside Road for a shared driveway was withdrawn by the applicant. The applicant decided to revise the plan and reapply next year.
By-laws
None were passed. The Committee of Adjustment does not pass by-laws. It only reviews applications and makes recommendations to Council, which passes all by-laws. You can read more about how zoning decisions work on our zoning guide.
