What is an operating variance?
An operating variance allows you to use your property in a way that does not match the rules in Zoning By-law 2016-040. Unlike physical variances for fences or setbacks, an operating variance deals with how a business or activity runs. The Committee of Adjustment reviews these requests to make sure the use will not harm nearby residents.
When you need one
You may need an operating variance if you want to:
- Run a home-based business with specific operating hours that go outside the allowed timeframe
- Erect or enlarge a sign that does not meet size or placement rules
- Host a temporary event or market on a residential lot
- Keep a small number of animals that exceed the standard limit for a residential zone
How to apply
- Complete the Operating Variance Application Form. You can download it online or pick one up at City Hall.
- Attach a site plan showing the property lines, existing structures, and where the proposed operation or sign will be located.
- Pay the application fee of $300.00. You can pay by credit card online, by mail, or in person at the Service Wrenford counter.
- Submit your package to the Planning & Development office, 3rd Floor, 100 Mercer Street, Wrenford, ON N4Q 1A1.
Timelines and process
Once we receive your application, staff will complete a 20-business-day completeness check. If everything is in order, we will add your request to the monthly hearing schedule. The Committee meets on the third Wednesday of each month.
When a hearing date is set, we mail a notice to all property owners within 60 metres of your site. The public has a 30-day public notice period to submit written comments or request to speak at the hearing. Staff will review all feedback before the Committee makes a decision.
Fees
The application fee is $300.00, as set out in Fees and Charges By-law 2025-151. If you need to reschedule or cancel your hearing, please contact the Committee Secretary at least five business days in advance. Late cancellations may result in a rebooking fee.
Appeals
If your application is approved, the variance takes effect immediately. If it is refused, or if a neighbour appeals the decision, you have a 30-day appeal window from the date the decision is mailed. You can file an appeal to the Committee of Adjustment or the Local Planning Tribunal. Find the appeal forms and step-by-step instructions on our appeals page.
