What is a minor variance?
A minor variance lets you make small changes to your property when the strict rules in the Zoning By-law 2016-040 would otherwise stop you. The Committee of Adjustment reviews these requests to ensure they fit the neighbourhood and do not harm neighbouring properties. Under the Planning Act, 2001, a minor variance must meet four tests: the change is minor in nature, desirable for the general good of the area, not serious or oppressive to neighbours, and consistent with the spirit and intent of the Official Plan and zoning rules.
Common reasons to apply include needing a slightly smaller front yard setback, allowing a deck to sit a little closer to a side line, or increasing building coverage by a small amount.
How to apply
Before you submit your application, we strongly encourage a pre-consultation with a planner. This helps you understand if your project is likely to be approved and what documents you will need.
- Download the Minor Variance Application Form.
- Complete the form and attach a current survey, a detailed site plan showing existing and proposed structures, and a letter of explanation.
- Submit the completed package to Planning & Development along with the application fee.
- Staff will review your application for completeness. If it meets all requirements, it is scheduled for a Committee of Adjustment hearing.
Application fee and timeline
The application fee for a minor variance is $350.00. This fee covers the cost of processing your request and providing public notice. The Committee of Adjustment meets on the third Wednesday of each month at 6:00 p.m. in the Council Chambers at City Hall. Decisions are typically made within 45 days after your application is deemed complete.
Public notice and hearings
When you apply, we will place a sign on your property and mail notices to all adjacent property owners. This gives your neighbours a chance to share their views. If the Committee needs more information, you may be asked to attend the hearing in person or virtually. You can also speak at the meeting to support or oppose the request. Each person is given five minutes to speak.
What happens after a decision
If approved, you will receive a Certificate of Minor Variance. You must complete the approved work within one year, or the variance expires. If your project is not completed on time, you must reapply. You can also appeal the Committee's decision to the Ontario Land Tribunal within 20 days, though most approvals are accepted without issue.
