What you can appeal

If you disagree with a decision made by the Committee of Adjustment about a minor variance or a consent to convey, you have the right to appeal. You can appeal within 20 days of the day the decision notice was mailed to you. The City of Wrenford, the applicant, and anyone who made a written or oral presentation at the hearing can file an appeal.

How to file an appeal

  1. Get your decision notice. The notice will include the date of the hearing, the application number, and a summary of the decision. Keep this document safe, as it starts your appeal clock.
  2. File your notice of appeal. You must file a Notice of Appeal with the Local Land Tribunal. You can download the form and instructions online. The deadline is strictly 20 days from the date on your decision notice. Late appeals are usually rejected.
  3. Pay the filing fee. The current filing fee is $175.00. The tribunal will send you a receipt once payment is processed. If you cannot pay, ask the tribunal about fee waivers.
  4. Serve the notice. You must send a copy of your filed notice to the City of Wrenford, the applicant, and anyone else who made a presentation at the hearing. You can do this by registered mail or personal delivery.
  5. Notify the City. Email a copy of your filed notice and proof of service to [email protected]. This helps the City's legal team prepare for the hearing.

What happens next

Once the tribunal receives your appeal, the City's legal counsel will represent the City's interest in the matter. The Committee of Adjustment office, led by Secretary-Treasurer Farid Haddad, will provide the tribunal with all hearing notes, application materials, and by-law references. You do not need to hire a lawyer, but you may choose to do so. The tribunal will schedule a hearing and send you a date, time, and location. Hearings are usually held in person at Wrenford City Hall or virtually.

Prepare for the hearing

Bring copies of your evidence, photographs, and any expert reports. The tribunal officer will explain the process before the hearing begins. You will have a chance to speak, and the City's lawyer and the applicant will also have a chance to speak. The tribunal officer will make a decision and send a written decision to everyone involved within 30 days of the hearing. The tribunal's decision is final and legally binding.
