Appeal a decision to the tribunal

Learn how to appeal a City of Wrenford planning, assessment, or by-law decision to an independent tribunal.

Appeal a decision to the tribunal

If you disagree with a decision made by the City of Wrenford, you have the right to appeal it to an independent tribunal. These tribunals act as a check on municipal authority and ensure that all decisions are fair and follow the law. The type of tribunal you need depends on the decision you are challenging.

Which tribunal handles your appeal?

  • Local Planning Appeal Tribunal (LPAT) — Hears appeals on decisions under the Planning Act. This includes zoning by-law amendments, official plan amendments, site plan control decisions, and minor variances. You must file your appeal within 30 days of receiving the City's decision notice.
  • Assessment Review Board (ARB) — Hears appeals about the assessed value of your property or business on the property assessment notice. Appeals must be filed by the deadline printed on your assessment notice.
  • Wrenford Licensing and Community Standards Board — Hears appeals against by-law compliance orders, Provincial Offences Act tickets, and certain licence decisions. You have 20 days to file an appeal after receiving your notice.

How the appeal process works

Tribunals are quasi-judicial bodies. This means they must act fairly, follow the rules of natural justice, and weigh evidence before making a decision. You have the right to a public hearing, the right to present your case, and the right to bring a lawyer or representative. The tribunal will review the City's decision and decide whether to uphold it, change it, or send it back for reconsideration.

Every appeal has a strict filing deadline. The deadline is always stated on your notice of decision or assessment. If you miss the deadline, you usually lose your right to appeal. Make sure you keep a copy of everything you submit.

Preparing your case

To start an appeal, you must complete the correct application form and pay the required filing fee. For the Local Planning Appeal Tribunal, the filing fee is $150.00. The Assessment Review Board and the Wrenford Licensing and Community Standards Board have their own fee schedules.

When you prepare your appeal, gather all the documents that support your position. This includes the City's decision letter, any plans, photos, expert reports, or correspondence you have. Write a clear statement explaining why you disagree with the City's decision and what outcome you are asking for. You do not need legal training to present your case, but complex cases may benefit from professional advice.
