What is a change of use?
A change of use happens when you want to operate a business in a commercial or industrial space that is currently zoned for a different type of business. For example, moving a restaurant into a space that was once an office requires a change of use.

Why do you need a permit?
The City needs to make sure your new business fits the zoning rules for the area and that the building is safe for you, your staff, and your customers. The permit process checks the space against the Ontario Building Code.
Development Permit and Building Permit
You will usually need two permits to open your business:
- A Development Permit confirms your business is allowed in that zone. Staff will check parking, floor space, and compatibility with nearby properties.
- A Building Permit reviews the safety of the space. Even if you are not doing renovations, the City checks washrooms, fire alarms, sprinklers, emergency exits, and lighting. If you are doing renovations, you will also need a renovation permit.
How long does it take?
Standard applications are reviewed in five to 10 business days. If your proposed use is discretionary, the review takes five to 10 business days, followed by a 21-day public notice and appeal period under the Planning Act. Processing may take longer during the busy construction season (April 1 to October 31).
How much does it cost?
Fees are set out in the Fees and Charges By-law 2025-151. You will pay the development permit fee when you apply. The building permit fee is based on the value of work or a flat application rate. You can estimate your costs using the Building Permit Fee Calculator.
How to apply
You can apply online or by email. Please prepare the following documents:
- Completed Change of Use Application Form
- Letter of Authorization (if you are not the property owner)
- Site plan showing the proposed layout
- Floor plans for the space
Submit your complete package to the Planning & Development office at 100 Mercer Street, or email your request. We will review your documents and contact you if we need more information.
Next steps
Once your permits are approved, you must get a Business Licence before you open your doors. You can apply online through the Business Services portal. If you already have a City business licence, we can update your account with your new location details.
