What you can appeal

If your building permit application is refused, or if it is approved with conditions that make your project impossible to build, you can appeal the decision. Under Ontario law, you have the right to request a review of planning and building decisions that affect your property.

Who hears your appeal

The path for your appeal depends on the reason for the refusal or the condition attached to your permit:

  • Building Code issues: If the refusal is about safety, structural requirements, or the Ontario Building Code, your appeal goes to the Chief Building Official.
  • Zoning or Official Plan issues: If the refusal is about setbacks, height limits, lot coverage, or permitted uses, your appeal goes to the Committee of Adjustment or the Local Planning Appeal Tribunal (LPAT).

How to file your appeal

To start the process, you must submit a complete application package. Incomplete files will be returned and will not count toward your deadline.

  1. Complete the Building Permit Appeal Form.
  2. Attach clear site plans and drawings showing your proposed changes.
  3. Write a brief statement explaining exactly why you disagree with the decision and what you would like the reviewer to change.
  4. Pay the required appeal fee.

You must file your appeal within 30 days of receiving your original permit decision. If you need more time, you can request an extension in writing, but extensions are not guaranteed.

Appeal fees

Appeal fees are set out in Fees and Charges By-law 2025-151. Payment is required when you submit your application. Fees are non-refundable.

Type of Appeal Fee
Building Code Act Appeal (Chief Building Official) $450.00
Planning Act Appeal (Committee of Adjustment) $350.00
Local Planning Appeal Tribunal (LPAT) Filing Fee $1,250.00

What happens after you file

Once your application is received, the department will check it for completeness. If everything is in order, you will receive a confirmation letter with your appeal number.

If a hearing is required, you will receive a formal notice with the date, time, and location. Hearings are usually held at Wrenford City Hall or over the internet. You will be given the chance to present your case, and City staff will also speak. After the hearing, the reviewer will make a decision and mail it to you within 30 days.

The decision is final for the City. If you disagree with a planning decision made by the Committee of Adjustment, you may have the right to take it further to the LPAT, subject to strict time limits and legal advice.
